Know Your Rights: Dutch Deposit Law
Max Deposit: 2 Months' Rent
Since July 2023, landlords cannot charge more than 2 months' basic rent as deposit. If you paid more, you may be able to claim the excess back.
14-Day Return Rule
Landlords must return your deposit within 14 days of handover. If they want to deduct costs, they have 30 days with a detailed breakdown.
Normal Wear & Tear = Free
Faded paint, minor scuffs, worn carpet from normal use — these are NOT deductible. Only damage from negligence or misuse can be charged.
Painting Is Usually Free
Dutch courts consistently rule that repainting after normal tenancy is a maintenance cost for the landlord, not the tenant. Don't let them charge you €500+ for this.
Demand Itemized Breakdown
Your landlord must provide a detailed, itemized list of deductions. Vague charges like general cleaning or repairs are not acceptable.
You Can Dispute
If you disagree with deductions, send a registered letter (aangetekende brief). The Huurcommissie and Juridisch Loket offer free advice.
Common Landlord Tricks (and How to Beat Them)
The walls must be repainted
Normal tenancy wear = landlord's cost. Only intentional damage (big holes, graffiti) is chargeable. We repaint to professional standard for a fraction of what they'd charge.
Professional cleaning required — we'll use our preferred company
You have the right to arrange your own cleaning. Their preferred company often charges 2-3x the market rate. We clean to the same standard for less.
Carpet replacement needed
Normal wear and fading is not chargeable. If the carpet is genuinely damaged, we offer steam cleaning from €75 — far less than replacement.
Furniture removal fee: €1,500
We clear a full apartment from €250. Donation, recycling, or disposal — your choice. No inflated invoices from partner companies.
Administrative/handling fee
There is no legal basis for administrative fees at move-out. This is a pure profit charge. Don't pay it.
